Terms of Use

These Terms of Use (“Terms”) are a legal agreement between you and Advantage Advisors LLC, a Florida limited liability company (“DayStayed,” “we,” “us”), governing your use of the DayStayed app and website (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

The Service

DayStayed helps you track how many days you spend in each state or country by recording your daily location and counting days by jurisdiction. The Service produces a record of location facts and day-counts.

DayStayed is not tax or legal advice. It does not determine your residency, domicile, or tax liability, and the default thresholds are starting points, not legal conclusions. Day-counts depend on the data recorded and on rules that vary by jurisdiction and change over time. You are responsible for verifying any result with a qualified tax or legal professional before relying on it. We do not warrant that day-counts are complete or accurate.

Your account

You must provide accurate information when you create an account and keep it current. You are responsible for your password and for activity under your account. Notify us promptly of any unauthorized use. You must be at least 16 years old to use the Service.

Free and Pro features

Tracking, your dashboard, alerts, and manual day entry are free. DayStayed Pro is a paid subscription that unlocks the audit report, PDF and Excel export, multi-year history and reporting, and tracking of unlimited jurisdictions.

Subscriptions, billing, and cancellation

DayStayed Pro is offered as an auto-renewing subscription purchased through the Apple App Store:

• The current price is $99 per year, with a 7-day free trial for new subscribers. Pricing may change; any change applies to future billing periods and will be disclosed before it takes effect.
• Payment is charged to your Apple ID account at confirmation of purchase or at the end of the free trial.
• The subscription automatically renews for the same period unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the period ends.
• You can manage or cancel your subscription, and turn off auto-renew, in your Apple ID account settings in the App Store after purchase. Deleting the app does not cancel the subscription.
• Any unused portion of a free trial is forfeited when you purchase a subscription.
• Purchases, billing, and refunds are handled by Apple under the App Store’s terms. Refund requests are made to Apple.

If your subscription lapses or expires, your account reverts to the free tier; your day log and tracking continue, and Pro features re-lock.

License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial residency-tracking purposes. You may not copy, modify, reverse-engineer, resell, or attempt to gain unauthorized access to the Service, or use it in any unlawful way or to infringe others’ rights.

Your content

You retain ownership of the location data, day entries, and notes you provide. You grant us the limited right to store and process that data to operate the Service for you, as described in the Privacy Policy.

Disclaimer of warranties

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that day-counts or reports are accurate or sufficient for any tax or legal purpose.

Limitation of liability

To the fullest extent permitted by law, DayStayed and its members will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your reliance on day-counts, reports, or other output of the Service, including any tax, penalty, or residency determination. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and governing law) will survive.

Apple App Store

These Terms are between you and DayStayed only, not with Apple. Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support for the Service. To the extent permitted by law, Apple has no warranty obligation with respect to the Service, and any claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to any warranty are our responsibility. Apple is not responsible for addressing any claims by you or a third party relating to the Service, including product-liability, legal-compliance, or intellectual-property claims. You agree to comply with all applicable third-party terms (including the App Store Terms of Service) when using the Service. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Florida, and you consent to their jurisdiction.

Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and change the effective date above. Continued use of the Service after a change means you accept the updated Terms.
