You are a Utah resident if you are domiciled in Utah, or if you maintain a permanent place of abode in the state and spend 183 or more qualifying days there. Utah’s day count is distinctive: only days where Utah is where you spent the most time count toward the 183.

The statutory residency test

Utah treats a non-domiciliary as a resident when two things are true in the same year: you maintain a permanent place of abode in the state, and you spend 183 or more qualifying days there. Meet both and Utah taxes you as a resident even if your true home is elsewhere. Utah’s day count is distinctive: only days where Utah is where you spent the most time count toward the 183.

How days are counted

A qualifying day in Utah is a day you spend more time there than in any other single state, so an ordinary travel day may not count. Days add up across every trip during the year, not just one stay.
